California Medical Malpractice - When Should You File A Lawsuit?

A recent CNN medical malpractice article raises the critical question, "Harmed in the hospital? Should you sue?"

When you or a loved experience a bad outcome after a visit to the doctor, many individuals are left wondering what to do.

Often, contacting a medical malpractice lawyer is the best step. Consulting with a knowledgeable California personal injury lawyer can help you determine if you have a case and may also help you obtain crucial answers.

Remember - as CNN legal analyst Jeffrey Toobin notes - "Malpractice is not about bad results; it's about bad conduct by medical professionals."

Some questions that you can ask yourself when considering if you should sue include:
• Is your outcome within the known risks?
• Did you recover?

California Tour Bus Accidents - Victims Right To Compensation

The recent tragic New York tour bus accident has raised questions concerning victims and their families' rights to compensation when serious personal injuries or a wrongful death occurs on a tour bus.

When a serious accident occurs it is critical to contact an experienced California personal injury attorney immediately to conduct an investigation and determine all the potential factors that may affect compensation.

In the New York bus accident, the driver had been sleeping before operating the bus, which then flipped on its side and killed 15 passengers as they returned home from a gambling trip. The accident is now being investigated by the National Transportation Safety Board. Looming questions include if fatigue played a role in the accident - witnesses indicate that the bus had veered off the road several times before crashing; if another vehicle clipped the bus, and if the company was negligent in hiring the driver based on his previous driving record.

An accident may simply be the fault of driver error. However, many times other factors contribute. For example, a tour bus company may owe a duty of care to bring its customers to and from a location safely. In order to ensure passengers safety, conducting a background check on its drivers is critical. The failure to perform adequate screening may lead to findings of fault against a company.

San Mateo Motorcycle Crash Kills One

San Mateo news reports that a motorcyclist was killed after colliding with a big-rig. Although the cause of the motorcycle accident is unknown, police suggest the truck and motorcycle both swerved to avoid an earlier accident and collided with each other. The truck driver did not stop at the scene.

If you or a loved on has been involved in a California truck accident or motorcycle accident, contact an experienced Stockton personal injury lawyer at once to investigate the accident and help you obtain the compensation you deserve.

Both truck drivers and motorcyclists face special considerations on the road. Due to the sheer size of an eighteen-wheeler, when trucks collide with another vehicle, the results are often tragic. Further, it takes longer and more space for trucks to maneuver. When an unforeseen obstacle - such as an accident - forces a truck to adjust, the truck driver and other motorists on the road need to allow enough space and time to make these critical adjustments.

Oakdale Pedestrian Accidents On The Rise

Oakdale news reports an alarming statistic. A 40-year-old woman crossing Highway 108 this week was the 17th pedestrian, bicyclist or skateboarder to be hit by a car or truck in Oakdale in a year.

The Oakdale pedestrian accidents have resulted in one fatality and numerous serious injuries. If you have been injured in a pedestrian accident, it is important to contact an experienced California personal injury lawyer immediately. Often the full impact of an injury isn't known until days, weeks or even months following an accident. It is important to speak to someone right away to preserve evidence and your rights.

As a result of the excessive number of accidents, Oakdale police are beginning to crack down - ticketing drivers who don't stop for people in the crosswalk and people who walk in front of cars before it is safe to cross.

"Distraction" is the number one reason cited for accidents, including drivers and pedestrians texting, eating, and putting on make-up.

Although most of the injuries have been minor, one death occurred after an intoxicated man was hit by a car while crossing Hwy. 108 at night, and a boy was seriously injured when he was run over by a car driving at slow speeds. The 40-year-old woman was crossing the highway during heavy traffic and was struck by a car.
